McPherson Lawn Care LLC Service Agreement

Service Schedule and Client Responsibilities

This agreement assumes continued service by McPherson Lawn Care, based on the client’s selected frequency (weekly, bi-weekly, monthly, or one-time). If the client’s lawn does not require mowing, it is the client’s responsibility to notify McPherson Lawn Care at least 48 hours before the scheduled service to avoid charges. Failure to provide timely notice will result in a cancellation fee of $10 for cancellations made less than 48 hours before service.

Service Scheduling

McPherson Lawn Care does not offer specific time slots for services to customers. Services are scheduled based on location and route optimizations to ensure efficiency and quality of service. Due to fluctuations in route density, there may be occasions when typical service days are adjusted and a notification will be sent out to affected customers no less than 2 days before scheduled. Customers will receive an arrival window notification between 5 minutes and 60 minutes from the time of our arrival.

The property must be accessible to our team on the scheduled service day between the hours of 8:00 am and 6:00 pm. If the entire property is not accessible or if the customer cancels upon our arrival, a cancellation fee may apply as outlined in the terms and conditions of the contract.

Term and Termination

Clients may terminate the contract at any time; however, a termination fee of 50% of the cost of the remaining scheduled services in the contract will be charged. McPherson Lawn Care also reserves the right to terminate this contract at any time and waive any fees associated with the termination at their discretion. If McPherson Lawn Care self terminates this contract, there will be no termination fee. The term of this contract is located at the top of this contract. Pay-As-You-Go does not have a set term and no termination fee is applied.

Continuation of Services Clause

McPherson Lawn Care herein provides its services under the presumption of continued engagement until such a time as the client or customer expressly requests the cessation of said services. Requests to terminate services must be submitted within the permissible timeframe as outlined in the “Service Schedule and Client Responsibilities” section of this Agreement. In instances where the client is engaged under a term contract, the termination provisions stipulated within this Agreement shall apply to any and all remaining visits that are scheduled within the contractual term limit.

Upon the conclusion of a term contract, the agreement automatically transitions to a Pay-as-You-Go contract basis. Should a request to discontinue services be made subsequent to the expiration date of the term contract, no termination fees shall be incurred. 

Properties with Access Control

McPherson Lawn Care assumes the whole lawn is to be maintained and quotes as such. If parts of the property become inaccessible, the client will still be charged for full property care. A minimum charge of 50% of the per-visit cost will apply if a return visit is required before the next scheduled service due to lost access at the time of the initial mow. Overgrowth fees may apply for any area that becomes accessible after being previously inaccessible.

Payment Procedure

• Residential Clients: Payment is due at the end of each visit, with a card on file before services begin. Failure to process payment within 24 hours will result in a 10% late fee of the invoice total per day. For once-a-month clients, payment is due on the day of service before services begin, or as noted at the beginning of each month at the top of this contract.
• Commercial Clients: Payment is due before the next scheduled service or within 7 days after receiving an invoice if no future service is scheduled. A 10% late fee of the invoice total per day will apply for late payments.

Damages and Lawn Maintenance Waiver

The property owner or occupant is responsible for maintaining a clean and well-kept lawn. McPherson Lawn Care is not liable for damages caused by debris or poorly maintained lawns. This includes but is not limited to toys, sticks, rocks, acorns, and seeds that may be propelled by our equipment, causing damage to property or surrounding areas. Any damages resulting from improper maintenance of the property by the owners or occupants waive all financial responsibilities to McPherson Lawn Care.

Hazards

The property owner or occupant is responsible for removing biohazards, including animal fecal matter, before each service. A $10 fee will be added for excessive fecal matter. It is also the responsibility of the owners or occupants to notify McPherson Lawn Care of any physical hazards in the lawn that may pose a risk to our crew or damage our equipment, such as tree stumps, rocks, and embedded rocks. 

Trial Period Clause:

At the commencement of this agreement, there shall be a trial period consisting of two initial visits. During this period, the Client shall have the opportunity to discuss any concerns with McPherson Lawn Care, and McPherson Lawn Care shall have the opportunity to remedy any issues that may arise.

Cancellation During Trial Period:

The Client reserves the right to cancel the term agreement at any point between the second and third visit without incurring any termination fees. To initiate cancellation during the trial period, the Client must send a cancellation request via email to McPherson Lawn Care at customerservice@mcphersonlawncare.com within the allowed cancellation period.

Activation of Term Agreement:

Failure to send a cancellation request within the allowed cancellation period will result in the full activation of the term agreement. Subsequent agreement cancellations after the trial period will be subject to the terms and conditions outlined in the agreement’s “term and termination” clause.

Overgrowth Procedure and Fees

Overgrowth fees are required to be paid before services begin. Fees are based on the height of the grass:

1. 6″-12″: +50% of the standard service rate.
2. 12″-24″: +100% of the standard service rate.
3. 24″+: Service will be deemed unserviceable, and a separate quote will be provided.

Credit/Debit Card Authorization Clause:

By entering into this agreement with McPherson Lawn Care, the Client hereby authorizes McPherson Lawn Care to charge any credit or debit card on file for the following purposes:

1. Payment for Services: The Client authorizes McPherson Lawn Care to automatically charge the credit or debit card on file for the total amount due for services rendered as per the agreed-upon terms outlined in the service agreement.
2. Recurring Payments: If applicable, the Client authorizes McPherson Lawn Care to set up recurring payments for ongoing services. The Client understands and agrees that these recurring payments will be automatically charged to the credit or debit card on file at the agreed-upon intervals.
3. Additional Charges: The Client authorizes McPherson Lawn Care to charge the credit or debit card on file for any additional charges incurred, such as late fees, penalties, or additional services requested by the Client beyond the scope of the original agreement.
4. Authorization Duration: This authorization shall remain in effect for the duration of the agreement between the Client and McPherson Lawn Care, including any renewal or extension thereof, unless otherwise revoked by the Client in writing.
5. The Client acknowledges and agrees: to maintain valid and up-to-date credit or debit card information on file with McPherson Lawn Care throughout the duration of the agreement. The Client also agrees to promptly notify McPherson Lawn Care of any changes to the credit or debit card information provided.

 

Revocation of Authorization:

The Client reserves the right to revoke this authorization at any time by providing written notice to McPherson Lawn Care. However, the Client acknowledges that revocation of this authorization may result in the termination of services or the imposition of alternative payment arrangements as determined by McPherson Lawn Care.

This agreement applies to homeowners, occupants, tenants, rental management companies, and the signatory of this contract. By accepting service from McPherson Lawn Care, the client agrees to the terms outlined in this agreement. Our commitment is to provide quality lawn care services while maintaining clear and transparent communication with our clients.
